Around 1200 hours he went out to the truck and noticed 3 chips in the paint on the driver’s side front fender. Caller advised that the chips in the paint were not there when he parked the truck. Caller believed that the chips had been caused by gravel coming off of a front end loader that was working in the area. The job foreman for Majors Enterprises Inc (the crew working on Maple Street), arrived on scene. He disputed the accusation that his driver's gravel had caused the damage to caller’s truck. Malachi was advised to have a valid driver pick he and the vehicle up.

Upon further investigation, Gar Welsch, was placed into custody for OVI. He was transported to the police department where he submitted a breath test which resulted in a .226% BAC. He was subsequently issued a citation for OVI (ORC 4511.19A1a) and OVI Super Concentration (ORC 4511.19A1h). He was released to his son. See case for further information.
